These Terms of Service ("Terms") are a binding agreement between you — either individually or on behalf of the organisation you represent ("you", "Customer") — and Earlydays Innovations Private Limited ("RealRevenue", "we", "us"), governing your access to and use of the RealRevenue website, application and APIs (together, the "Service").

By creating an account, connecting a lead source, or using the Service in any way, you accept these Terms. If you are agreeing on behalf of an organisation, you represent that you have the authority to bind it. If you do not agree, do not use the Service.

1. The Service

RealRevenue collects leads from sources you connect — including Facebook and Instagram Lead Ads, web forms and manual entry — into a shared inbox, and helps your team follow up over WhatsApp, SMS and email. Features vary by plan; the plan page at the time of your purchase describes what your plan includes.

We may add, change or remove features. We will not materially reduce the core functionality of a paid plan during a paid term without giving you notice and, if you object, a pro-rata refund for the unused portion.

2. Accounts and eligibility

  • You must be at least 18 and legally able to enter contracts.
  • You must provide accurate registration information and keep it current.
  • You are responsible for everything that happens under your account, including the actions of team members you invite.
  • You must keep your credentials confidential and notify us promptly at support@realrevenue.in if you suspect unauthorised access. We strongly recommend enabling two-factor authentication.
  • A workspace owner controls the workspace's data and may add, remove or change the access of team members at any time.

3. Plans, trials and billing

  • The Starter plan is free and subject to the usage limits published on the pricing page. We may change those limits with notice.
  • Paid plans are billed per user, in advance, monthly or annually as you select. Fees are stated exclusive of taxes; you are responsible for any applicable taxes.
  • Trials convert to a paid subscription at the end of the trial period unless you cancel before it ends.
  • Subscriptions renew automatically for successive terms until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid term.
  • Except where required by law or expressly stated in these Terms, fees are non-refundable and we do not provide refunds for partial periods or unused capacity.
  • If a payment fails, we may suspend access after notifying you and allowing a reasonable period to cure.
  • We may change our prices with at least 30 days' notice, effective at your next renewal.

4. Your data

You retain all rights to the data you or your leads put into the Service ("Customer Data"). We claim no ownership of it.

You grant us a limited, worldwide, non-exclusive licence to host, process, transmit and display Customer Data solely to provide, secure and support the Service. This licence ends when the data is deleted.

For personal information contained in Customer Data, you are the data controller and we are the processor acting on your instructions. You are responsible for having a lawful basis to collect and to contact your leads, and for giving them whatever notice the law in their jurisdiction requires. Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.

You can export your data at any time while your account is active. On termination we retain it for 30 days so you can retrieve it, after which it is permanently deleted.

5. Acceptable use

You may not, and may not permit anyone else to:

  • Upload, import or process data you do not have the right to process.
  • Use the Service to send unsolicited bulk messages, or to contact people who have not consented or who have opted out, in breach of applicable anti-spam and telemarketing law (including but not limited to the TCPA, CAN-SPAM, GDPR, PECR, and India's TRAI regulations).
  • Send content that is unlawful, fraudulent, deceptive, harassing, defamatory, or that infringes anyone's rights.
  • Breach the terms of any platform you connect, including the Meta Platform Terms, the WhatsApp Business Messaging Policy, or the terms of any SMS or email provider.
  • Resell, sublicense or expose the Service to third parties as your own product without a written agreement with us.
  • Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent that restriction is unenforceable by law.
  • Probe, scan, or test the vulnerability of the Service, or circumvent any authentication, rate limit or security measure, other than under a written authorisation from us.
  • Interfere with the Service's operation, or place an unreasonable load on it through automation or excessive requests.
  • Use the Service to develop a competing product, or to benchmark it for publication without our consent.
You are solely responsible for the content and the legality of every message sent through the Service. Messaging platforms enforce their own policies and may block or ban a sender independently of us.

6. Third-party platforms

The Service integrates with platforms we do not control, including Meta (Facebook and Instagram), Google, and messaging providers. Your use of those platforms is governed by their own terms and policies, and their availability, rate limits, permission requirements and API behaviour may change at any time.

We are not responsible for a third-party platform's acts, omissions, downtime, policy changes, or for the suspension of your account on that platform. If a platform revokes access, changes its API, or discontinues a feature, we may need to modify or discontinue the corresponding functionality in the Service.

You are responsible for holding the necessary rights and permissions on any account you connect — for example, being an administrator of the Facebook Page whose leads you want to receive, and having lead access granted to your business.

7. Intellectual property

The Service, including its software, design, documentation, trade marks and the RealRevenue name and logo, is owned by Earlydays Innovations Private Limited and protected by intellectual property law. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Service during your subscription — nothing more.

If you send us feedback or suggestions, you grant us an unrestricted, perpetual, royalty-free right to use them without obligation to you.

8. Confidentiality

Each party may receive information the other treats as confidential. Each party will protect the other's confidential information with at least reasonable care, use it only to perform under these Terms, and not disclose it except to personnel and advisers bound by comparable obligations, or as required by law after giving reasonable notice where legally permitted.

9. Availability and support

We aim for high availability but do not guarantee uninterrupted service except where a written service level agreement applies to your plan. We may perform maintenance, and will give advance notice of planned downtime where practicable.

Support is provided by email at support@realrevenue.in on all plans, with faster response targets on higher plans as described on the pricing page.

10. Suspension and termination

  • You may cancel your subscription or close your account at any time from Settings, or by emailing us.
  • We may suspend or terminate access immediately if you materially breach these Terms, if your use threatens the security, integrity or availability of the Service or another customer, or if we are required to do so by law or by a platform we depend on.
  • Where the circumstances allow, we will notify you and give you a reasonable opportunity to fix the problem before suspending.
  • On termination your right to use the Service ends. Sections covering your data, intellectual property, confidentiality, disclaimers, liability, indemnity and governing law survive.

11. Disclaimers

Except as expressly stated in these Terms and to the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that it will deliver every lead from every connected platform.

Lead delivery depends on third-party platforms. We do not warrant that every lead submitted on a third-party platform will reach your account, and we are not liable for leads lost due to a platform's outage, a revoked or expired token, a permission you removed, or a configuration you changed.

12. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business or lost or corrupted data, even if advised of the possibility.

Each party's total aggregate liability arising out of or relating to these Terms is limited to the greater of the amounts you paid us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars.

These limits do not apply to your payment obligations, to either party's indemnity obligations, or to liability that cannot be excluded or limited by applicable law — including death or personal injury caused by negligence, and fraud.

13. Indemnity

You will defend and indemnify us against third-party claims, and the resulting damages, losses and reasonable legal costs, arising from your Customer Data, your use of the Service in breach of these Terms or applicable law, or messages sent through the Service to recipients who did not consent to receive them.

14. Changes to these Terms

We may update these Terms. For material changes we will give account holders at least 30 days' notice by email or in-app. Continuing to use the Service after the change takes effect means you accept the updated Terms; if you do not, you may cancel before the effective date and we will refund any prepaid fees for the unused portion of your term.

15. General

  • Governing law — these Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of Gautam Buddh Nagar, Uttar Pradesh, India have exclusive jurisdiction.
  • Entire agreement — these Terms and the Privacy Policy are the entire agreement between us on this subject and supersede any prior understanding.
  • Severability — if any provision is held unenforceable, the rest remains in force and the unenforceable provision is limited to the minimum extent necessary.
  • No waiver — a failure to enforce a provision is not a waiver of the right to enforce it later.
  • Assignment — you may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
  • Force majeure — neither party is liable for delays caused by events beyond its reasonable control.
  • Independent contractors — nothing here creates a partnership, joint venture, agency or employment relationship.
